Is it illegal to purchase fake/replica Oakley sunglasses?
I've heard that Oakley, Inc has prosecuted websites selling knock-offs of their high end sunglasses. It's patent infringement to sell items with the Oakley name. But is it illegal to purchase them? And if so, how serious of a violation is that?
Yes. But many versions of this and other knock-offs crop up on eBay and other auction/sale websites if not the "street". Although the burden lies primarily on the seller, in most instances, the buyer is not the one and very unlikely to be the one prosecuted. (depending on circumstances)
Please note, that the "middle man" is often also the victim of these types of sales. Ultimately, it is the responsibility of both the buyer and seller to be informed.
